LA PROVINCIA ARGENTINA QUE QUIERE CULTIVAR SU PROPIO CANNABIS

La justicia argentina sigue siendo agresiva con los autocultivadores y cultivadores solidarios. Sin embargo, algunas provincias sí pueden darse el lujo de discutir marcos legales que les permitan producir su propio cannabis.

Uno de esos casos es Santa Fe, en el litoral este, la provincia en la que nació Lionel Messi, Fito Páez y el fallecido boxeador Carlos Monzón, entre otros.

El periódico Página 12 da cuenta de que un proyecto de autoabastecimiento de cannabis con fines terapéuticos fue aprobado por la Comisión de Salud Pública de la cámara de Diputados local.

El hecho ha generado expectativas favorables para su sanción definitiva. El Ministerio de Salud será la autoridad que valide la legitimidad del cultivo de cannabis.

El proyecto impulsa la autorización y legitimidad del autoabastecimiento de cannabis con fines terapéuticos en Santa Fe.

La iniciativa había sido presentada el año pasado por los legisladores de Igualdad y Participación, Rubén Giustiniani y Silvia Augsburger, quien concluyó su mandato en diciembre, y fue impulsada nuevamente por quien ocupó su banca en el espacio, Agustina Donnet.

La norma establece que las personas autorizadas tendrán derecho a solicitar y recibir una certificación oficial de parte del Ministerio de Salud provincial, que será la autoridad de aplicación, que valide la autorización y legitimidad de su cultivo de cannabis, además de brindar asesoramiento y facilitar el control de calidad a través de los entes estatales.

“Pensamos que el Estado tiene que disponer de terrenos para el cultivo de cannabis con fines terapéuticos, pero también entendemos la realidad de aquellas familias que lo quieren hacer en su casa y que el Estado debería autorizar”, planteó la diputada Donnet.

La lucha de las madres santafesinas que cultivan cannabis -y de todas las organizaciones que las acompañan- para producir el aceite con el que tratan las diferentes patologías de sus hijos, obteniendo resultados más que satisfactorios, pero en medio de la angustia e intranquilidad que les genera la prohibición del autocultivo, y el riesgo siempre latente de ser condenadas, sumó un nuevo capítulo.

Con la media sanción pasará a Senadores; y de aprobarse, Santa Fe se convertiría en la primera provincia del país en autorizar el autocultivo de cannabis con fines terapéuticos. El proyecto “autoriza a sembrar, cultivar y guardar cannabis y sus derivados a todas las personas radicadas en Santa Fe con recomendación médica para su uso terapéutico y a quienes cultivasen para abastecerles”; al punto de considerar esos destinos legítimos a los alcances de lo establecido en el artículo 5° inciso a) de la Ley Nacional 23.737.

La norma sobre Tenencia y Tráfico de Estupefaciente establece penas de prisión de hasta 15 años para el que siembre o cultive plantas o guarde semillas para  producir o fabricar estupefacientes, sin autorización o con destino ilegítimo.

“Ahí encontramos un huequito para avanzar porque la ley no aplicaría para las personas que están haciendo algo a favor de la salud, no se las puede penar”; explicó Fausto Botta, de la organización Despenalización Ya Santa Fe, que asesoró a los legisladores de Igualdad y Participación.

El hombre agregó que “las provincias se reservan la potestad en asuntos de salud pública y derechos humanos, o los comparte con la Nación. Por lo que pueden considerar que estos destinos se consideren legítimos y pueden autorizar a las personas a cultivar si pueden demostrar que la van a usar con fines terapéuticos”.

La autoridad de aplicación será el Ministerio de Salud provincial, que entre sus funciones se encargará de emitir el Certificado de Autoabastecimiento Legítimo de Cannabis.

También, confeccionar un registro de personas autorizadas que hayan tramitado el certificado dispuesto en la presente, brindar información y asesoramiento, y facilitar el control de calidad de los derivados por intermedio de entes estatales, según lo establecido en la Ley 13.602, sobre la incorporación de Medicamentos a base de Cannabis en Formulario Terapéutico Provincial.

Según Botta, el proyecto “dice claramente que lo que es importante es el destino de ese derivado, eso quiere decir que la persona que lo cultiva no es necesariamente la que la usa, podría otorgarle autorización a una persona designada el usuario terapéutico. Además, es muy importante que la provincia puede dar un asesoramiento y fomentar convenios con universidades y laboratorios públicos para que analicen los derivados”.

El bloque de Igualdad y Participación presentó además un pedido de informes respecto de las condiciones que tiene el Laboratorio Industrial Farmacéutico (LIF), tanto para el cultivo de cannabis como para el estudio y elaboración de los derivados con fines terapéuticos.

También impulsan un proyecto de ley para el abordaje de los consumos problemáticos en el territorio provincial. “Es muy preocupante porque vemos que no hay un abordaje desde la salud pública”, planteó la diputada Donnet.

“Nos parece importante, en medio de la pandemia, hablar del tema. Para nosotras es necesario cultivar en nuestros domicilios para asegurarle la medicina a los chicos, es la única herramienta que tenemos. Por eso apoyamos este proyecto y estamos esperanzados en su tratamiento”, dijo Laura Acosta, referente de Mamás Cannabis Medicinal Santa Fe.

The Equality and Participation block also presented a request for reports regarding the conditions of the Industrial Pharmaceutical Laboratory (LIF), both for the cultivation of cannabis and for the study and preparation of derivatives for therapeutic purposes.

They are also promoting a bill to tackle problematic consumption in the provincial territory. "It is very worrying because we see that there is no approach from public health," said deputy Donnet.

"It seems important to us, in the midst of the pandemic, to talk about it. For us it is necessary to cultivate in our homes to ensure medicine for the boys, it is the only tool we have. That is why we support this project and we are hopeful in its treatment, ”said Laura Acosta, referent of Mamás Cannabis Medicinal Santa Fe.
