EL TIEMPO CORRE Y EN MÉXICO SIGUEN LUCHANDO POR PRESENTAR UN REGLAMENTO DEL CANNABIS

La llegada a la presidencia de Andrés Manuel López Obrador al poder hizo suponer que uno de sus caballitos de batalla en materia de derechos humanos, esto es la legalización del cannabis, saldría lo mas pronto posible.

Pero no. La burocracia, como en tantos otros casos, se ha devorado a la política, a punto tal que la Secretaría de Salud está a punto de caer en desacato.

Así lo da cuenta un editorial de El Economista firmado por Maribel Coronel que enfatiza que en poco tiempo habrá reglamento de cannabis y Salud no caerá en desacato.

Es claro que la Secretaría de Salud no quiere caer en desacato ante el Poder Judicial y está haciendo todo lo posible para entregar un anteproyecto de reglamento para el uso de cannabis medicinal dentro de dos semanas.

En los hechos la orden de la Suprema Corte de Justicia de la Nación (SCJN) específicamente es para la Comisión Federal de Protección contra Riesgos Sanitarios (Cofepris).

Sin embargo, ante la realidad de que el titular de dicho organismo no logra entender el tema y ni siquiera le interesa, sabemos que el área jurídica de la Secretaría de Salud a cargo de Maricela Lecuona tomó el asunto en sus manos y es de esperar que ahora sí el proceso tome agilidad.

Dicho reglamento está pendiente desde hace ya tres años cuando el Legislativo aprobó los respectivos cambios a la Ley General de Salud para legalizar el uso médico de los derivados de la marihuana.

Desde entonces, Cofepris tenía un plazo de 180 días para el respectivo reglamento y es la hora en que el país sigue esperándolo.

Cada vez hay más pacientes mexicanos que recurren a probar la cannabis como terapia arriesgándose a ser criminalizados, cultivando por sí mismos o comprando las opciones importadas a elevados precios o recurriendo al mercado negro.

Además, lo hacen sin acompañamiento médico porque falta la evidencia científica que precisamente es por donde hay que empezar.

Hay varios protocolos de investigación tocando la puerta de Cofepris sin respuesta desde hace meses.

La Corte dejó claro el pasado 9 de junio a los funcionarios de Salud que, con todo y la pandemia, deben cumplir su mandato constitucional; que dicha reglamentación del cannabis medicinal es una prioridad y que ya no hay lugar para más prórrogas, de modo que la fecha es inaplazable.

No lograrán tener el reglamentoo final pero si una versión para entregar la coordinación jurídica de modo que la pelota ya quede en manos de la presidencia para que presente su visto bueno y las observaciónes , así la versión estaría preparada para septimbre próximo.

Sabemos que la abogada de la secretaria de salud se ha tomado en serio el tema y ha reactivado el grupo de trabajadores dedicados a estos trámites .

Ya habían tenido sesiones a principios de año, pero el tema fue cancelado por la pandemia del COVID-19.

Fuentes cercanas al proceso informan que aunque no han hecho reuniones físicas, sí están trabajando en línea analizando y haciendo observaciones a una segunda versión de anteproyecto de reglamento donde se entiende ya fueron atendidos los comentarios de la primera versión a inicios de año.

O sea, sí ha habido avances y el anteproyecto lo tendrán pronto.

Entendemos que con esa versión buscarán formalizar el oficio con fecha de 30 de junio para enviarlo a Presidencia y con ello las autoridades de Salud cumplen y evitan el desacato al Poder Judicial; aún faltarán pasos del proceso incluido el visto bueno de la Consejería Jurídica de Presidencia que lleva Julio Scherer, pero por el lado de Salud se habrá cumplido.

Hay un punto en donde tal parece está costando trabajo de hacer definiciones y es el relativo a la siembra de la marihuana.

No sabemos si algo de ello se incluirá en el reglamento, pero conforme nuestras averiguaciones probablemente será uno de los aspectos donde se enfocará la discusión en los siguientes meses para terminar de afinar los controles por ejemplo de las ubicaciones permitidas, de la genética de las semillas y otros aspectos que son sumamente relevantes y que deben quedar muy claros.

In addition, they do it without medical support because the scientific evidence is lacking, which is precisely where to start.

There are several research protocols knocking on the door of Cofepris without response for months.

The Court made it clear on June 9 to Health officials that, with everything and the pandemic, they must fulfill their constitutional mandate; that said regulation of medicinal cannabis is a priority and that there is no longer room for further extensions, so the date is postponable.

They will not be able to have the final regulation but if a version to deliver the legal coordination so that the ball is already in the hands of the presidency to present its approval and observations, so the version would be prepared for next September.

We know that the attorney for the Secretary of Health has taken the issue seriously and has reactivated the group of workers dedicated to these procedures.
They had already had sessions at the beginning of the year, but the topic was canceled due to the COVID-19 pandemic.

Sources close to the process report that although they have not held physical meetings, they are working online analyzing and making observations on a second version of the draft regulation where it is understood that the comments of the first version were already addressed at the beginning of the year.

In other words, there has been progress and the preliminary project will be soon.

We understand that with this version they will seek to formalize the official notice dated June 30 to send it to the Presidency and with it the Health authorities comply and avoid contempt of the Judiciary; Steps in the process will still be missing, including the approval of the Presidential Legal Department led by Julio Scherer, but on the Health side, it will have been accomplished.

There is a point where it seems it is costing work to make definitions and it is the one related to the cultivation of marijuana.

We do not know if any of this will be included in the regulation, but according to our inquiries it will probably be one of the aspects where the discussion will focus in the following months to finish fine-tuning the controls, for example of the allowed locations, of the genetics of the seeds. and other aspects that are highly relevant and that must be made very clear.
