Las idas y vueltas de Argentina con la regulación del cannabis tienen ahora un nuevo capítulo.

Es que un borrador de la nueva reglamentación al que accedió el portal Infobae, dice que  el Gobierno permitirá el cultivo personal y el expendio de aceites en farmacias

El Ministerio de Salud les presentó el borrador de la nueva reglamentación de la ley a organizaciones, médicos y científicos.

En este documento se destaca que el Estado, además, buscará producir en el ámbito público marihuana terapéutica y garantizará el acceso gratuito a pacientes que no tengan obra social o mutualista.

La ley de cannabis medicinal fue sancionada en 2017 pero resultó muy criticada por pacientes, investigadores y médicos ya que no resolvió la demanda.

Ahora, el Gobierno dice que permitirá finalmente que los usuarios terapéuticos puedan cultivar en sus hogares la planta de cannabis, además de habilitar su expendio en farmacias y proyectar cultivos y producción pública.

Es una noticia que cambia el paradigma y el escenario después de 80 años de prohibición global y total.

La comunicó en una reunión virtual Ginés González García a organizaciones cannábicas, médicos, docentes y científicos que integran del Consejo Consultivo Honorario.

El ministro de Salud de la Nación les presentó el borrador de la nueva reglamentación de la ley, que contemplará la mayoría de los pedidos de los usuarios.

Y anulará la redactada por la administración del gobierno anterior, que había sido muy criticada por no resolver la demanda de los pacientes.

“Es un día importantísimo para demostrar que se puede gestionar de cara a la sociedad”, les dijo el Ministro desde su despacho vía teleconferencia, antes de dejar la cuestión técnica al mando de la secretaria de Acceso a la Salud, Carla Vizzotti.

La novedad más importante que contiene este borrador (que aprobará el consejo consultivo antes de seguir su curso hacia la firma del presidente Alberto Fernández y la publicación en el Boletín Oficial) es, sin dudas, el reglamento del artículo 8 de la ley 27.350, que incluye la autorización del cultivo personal y en red para los usuarios, investigadores y pacientes que se registren el Programa de Cannabis (REPROCANN).

Los límites en la cantidad de plantas permitidas en cada hogar o en las sedes de las organizaciones para los cultivos “en red” se conocerán recién cuando la cartera sanitaria redacte las resoluciones particulares, pero también será materia de discusión durante las reuniones que se desarrollen en los próximos días.

No obstante, la preocupación de las autoridades del REPROCANN está puesta no tanto en la cantidad sino en la calidad de lo que produzcan estos cultivos.

“La idea es controlar el producto final”, advirtió uno de los funcionarios responsables, que reconoció que la gratuidad total es un problema a la hora de generar accesos.

En este punto el borrador también se aclara que estará contemplada “la protección de confidencialidad de datos personales”.

El Ministro de Salud Ginés González García encabezó la reunión para anunciar el borrador de la nueva reglamentación de la ley de cannabis medicinal.

Esto no significa que cualquiera va a poder tener plantas de cannabis en sus casas pero sí que podrán entrar en el circuito de legalidad todos los cultivadores solidarios, familias y agrupaciones que, sin respuestas del Estado desde 2017, sostenían con mucha dificultad (por el riesgo de ir presos y los problemas para conseguir, por caso, semillas) la demanda de los usuarios, cuyo crecimiento fue exponencial en los últimos tres años.

“El rol de las organizaciones seguirá siendo clave”, advirtió Vizzotti, quien también les anunció a los integrantes del Consejo Consultivo que trabajarán para llevar al Congreso “una ley superadora”.

Aunque no dio detalles, es sabido que la diputada entrerriana del FdT Carolina Gaillard trabaja en un proyecto que modificaría la ley de drogas y despenalizaría el cultivo y la comercialización de cannabis para uso medicinal.

Hasta ahora, tener semillas y plantas en el ámbito privado, aun para consumo personal y terapéutico, está penado por la ley de drogas con hasta 15 años de prisión.

Al menos en el ámbito medicinal, esta decisión reglamentaria significará el fin de la criminalización de pacientes y cultivadores solidarios.

Otra de las novedades importantes que trae la reglamentación modelo 2020 es la posibilidad para los usuarios no sólo de importar productos medicinales de cannabis, que ya estaba permitido aunque solo para las epilepsias refractarias y vía ANMAT, sino también a partir del expendio en farmacias habilitadas para producir “formulaciones magistrales”, como aceites, tinturas o cremas.

“Los pacientes que no estén inscriptos en el Programa, pero que tuvieren como prescripción médica el uso de la planta de cannabis y sus derivados y su patología esté contemplada por el Programa, podrán adquirirlo a través de la importación de especialidades farmacéuticas o por formulaciones magistrales elaboradas por farmacias habilitadas a tal fin”, dice el texto borrador, al que tuvo acceso Infobae.
