El autocultivo de cannabis, así sea para uso medicinal, es una actividad de riesgo en Argentina.

Y no alcanza con que el Congreso haya votado una ley que fomenta las terapias con marihuana, la policía sigue siendo muy represiva con quien tiene plantas en su casa.

Ahora, un rayo de luz ilumina tanta oscuridad, ya que luego de muchos años de lucha se otorgaron los primeros permisos para el autocultivo.

El municipio rionegrino de San Antonio Oeste (sur del país), se ha convertido en el pionero del autocultivo.

En esa ciudad se hicieron entrega de los primero 41 permisos del país para el autocultivo de cannabis medicinal.

En uno de los documentos, dice: "Se certifica que la señora Maria Eugenia Sar se encuentra debidamente registrada en el registro de cannabicultores de uso medicinal" que habilita a la profesora de Letras de 57 años.

La mujer recibió la autorización para cultivar cannabis medicinal para tratar el Síndrome de Tourette que padece su nieto Joaquín Navarro de 9 años.

Sar afirmó que gracias a la puesta en marcha del registro “hoy hay 41 familias cultivando tranquilas, sin miedo a nada en San Antonio Oeste”, al punto que “todos se quieren mudar acá”.

El certificado fue extendido por el Consejo Asesor de Políticas relacionadas al Cannabis Medicinal y al pie de dicho documento sella “San Antonio Oeste es el único municipio que otorga permisos”.

Andrés Bacigalupo, coordinador del área de política de drogas de la Asociación Pensamiento Penal, comentó que hay otros siete distritos que sancionaron ordenanzas sobre autocultivo que no están en funcionamiento: Lamadrid, Hurlingham, San Vicente, Rivadavia, Berazategui y Lomas de Zamora y Viedma.

Todo está situación actual comenzó con un revés judicial el 21 de junio del 2019 que sufrió Eugenia Sar, una ciudadana grutense que en julio de 2018 había obtenido una medida cautelar que la autorizaba a cultivar cannabis con fines medicinales que luego fue revocada por la Cámara Federal de Apelaciones de General Roca.

“Y como el Estado Nacional nunca respondió la orden de otorgar el aceite, decidimos abandonar esa lucha judicial individual para enfocarnos en la legislación local, provincial y nacional, aprovechando el cambio de escenario con el nuevo gobierno”, explicó Sar en una nota a la Agencia de noticias Télam.

Fue así como el grupo "Cannabis Terapéutico San Antonio - Las Grutas" que integra Eugenia Sar junto a decenas de otros usuarios, profesionales de la salud, investigadores y cultivadores; presentaron con el concejal Nicolás Rochas un proyecto para modificar la ordenanza municipal 5834, de modo que permita el autocultivo de cannabis medicinal.

Finalmente esa ordenanza fue aprobada a fines de 2019 y en virtud de ella, este grupo dedicado hasta entonces solamente a actividades de capacitación, difusión y concientización, pasó a integrar el “Consejo Asesor de Políticas relacionadas al Cannabis Medicinal”, un ente mixto que es el encargado de administrar el flamante Registro de Usuarias y Usuarios que otorga las licencias.

La norma faculta a “sembrar, cultivar o guardar cannabis medicinal en las cantidades que determine el médico tratante” a cualquier paciente o “familiar hasta el segundo grado” de una persona que presente patologías diagnosticadas por profesionales “con matrícula habilitante”. 

Aclarando que a tal fin solo se pedirá con un solo requisito que es contar con la
orden médica que indique la necesidad de someterse a un tratamiento a base de cannabis medicinal.

Luego, la persona se presenta en la municipalidad con dicho certificado médico y con la declaración del domicilio donde va a realizar la cultivación.

Con el permiso, será el Consejo Asesor el que le indique cuántas plantas puede tener de acuerdo con sus patologías, sus necesidades y ratio entre cannabinoides (THC y CBD) que es indicado por el profesional tratante.

The rule empowers "to plant, cultivate or store medicinal cannabis in the amounts determined by the treating physician" to any patient or "relative up to the second degree" of a person presenting pathologies diagnosed by professionals "with an enabling license plate".

Clarifying that for this purpose it will only be requested with a single requirement that is to have the
medical order indicating the need to undergo a treatment based on medicinal cannabis.

Then, the person appears in the municipality with said medical certificate and with the declaration of the address where the cultivation is carried out.

With permission, it will be the Advisory Council that indicates the specific plants can have an agreement with their pathologies, their needs and relationship between cannabinoids (THC and CBD) that is indicated by the treating professional.
