PARAGUAY TRATA DE DESPENALIZAR EL USO DEL CANNABIS

El diario ABC da cuenta de un hecho histórico: Paraguay por fin discute la despenalización de su flor más bella.

“La Cámara de Diputados estudia en su sesión ordinaria del miércoles, convocada para las 08:30, el proyecto de ley que despenaliza el autocultivo de la marihuana para uso medicinal”, informaron los canales oficiales.

Este proyecto de ley cuenta con el dictamen de rchazo de la Comisión de Lucha contra el Narcotráfico, presidida por Tito Ibarrola.
Sus miembros aconsejan ratificarse en el rechazo inicial y para archivar el proyecto precisarán de 53 votos.
La norma señala que el que tuviere en su poder sustancias ilegales que el médico le haya recetado, o aquel que las tuviere para su exclusivo uso personal, estará exento de pena.

Pero si la cantidad fuere mayor de la recetada o la necesaria para uso personal, se le castigará con penitenciaría de dos a cuatro años y el descomiso.

Claro que en los casos en que el tenedor porte un certificado médico visado por el Ministerio de Salud Pública y Bienestar Social.

El mismo debe señalar que padece de dolencias tratables con cannabis medicinal, dice la norma que, lamentablemente, podría no ser tratada.

En una reunión viral hace unas semanas la Comisión decidió rechazar el proyecto de ley que busca modificar varias disposiciones de la legislación antidrogas.

El fin de la iniciativa era autorizar distintas formas de autocultivo medicinal legal, para tratar con CBD ciertas patologías.

Los diputados adoptaron esta postura teniendo en cuenta las recomendaciones del Ministerio de Salud Pública, la Fiscalía, la Secretaría Nacional Antidrogas (Senad) y los gremios de médicos.

“Básicamente lo que estas instituciones han sido aspectos relacionados con la Constitución Nacional, como así también a tratados internacionales y leyes vigentes que ya prevén la distribución gratuita de la producción y distribución del cannabis con fines medicinales”, expresó el presidente de la Antinarcóticos de la Cámara Baja, el diputado por Central Tito Ibarrola (PPH).

El dictamen deberá ser puesto a consideración del pleno cuando los diputados estudien este proyecto de ley.

Dicha propuesta está impulsada por Mamá Cultiva Paraguay y fue presentada por el senador Victor Ríos.

Pretendía permitir el autocultivo exclusivamente a pacientes que cuenten con una receta visada y registrada en el Ministerio de Salud.

El diputado Ibarrola recordó que desde la Comisión ya instado al Poder Ejecutivo, a través de una declaración, a proveer de manera inmediata la medicina a las personas que lo necesitaban y que está contemplado en una ley vigente pero que aún no se cumple.

Esta última dictamina que sólo las farmacéuticas pueden ser habilitada para importar esta materia prima. Aún así, se trata de un paso muy importante y estamos todos muy de acuerdo con ello.

The newspaper ABC reports on a historical fact: Paraguay is finally discussing the decriminalization of its most beautiful flower.

"The Chamber of Deputies is studying in its ordinary session on Wednesday, convened for 08:30, the bill that decriminalizes the self-cultivation of marijuana for medicinal use," reported the official channels.

This bill has the rejection opinion of the Commission for the Fight Against Drug Trafficking, chaired by Tito Ibarrola.
Its members advise to be ratified in the initial rejection and to archive the project they will need 53 votes.
The rule states that whoever has illegal substances that the doctor has prescribed, or whoever has them for their exclusive personal use, will be exempt from penalty.

But if the amount is greater than prescribed or necessary for personal use, you will be punished with a penitentiary of two to four years and decomposition.

Of course, in cases where the holder carries a medical certificate endorsed by the Ministry of Public Health and Social Welfare.

He must indicate that he suffers from ailments treatable with medical cannabis, says the norm that, unfortunately, could not be treated.

In a viral meeting a few weeks ago, the Commission decided to reject the bill that seeks to modify various provisions of the anti-drug legislation.
The purpose of the initiative was to authorize different forms of legal medicinal self-cultivation, to treat certain pathologies with CBD.

The deputies adopted this position taking into account the recommendations of the Ministry of Public Health, the Prosecutor´s Office, the National Anti-Drug Secretariat (Senad) and the medical unions.

"Basically what these institutions have been aspects related to the National Constitution, as well as international treaties and current laws that already provide for the free distribution of the production and distribution of cannabis for medicinal purposes," said the president of the Antinarcotics of the Lower House, the deputy for Central Tito Ibarrola (PPH).

The opinion must be submitted to the plenary for consideration when the deputies study this bill.

This proposal is promoted by Mamá Cultiva Paraguay and was presented by Senator Victor Ríos.

It intended to allow self-cultivation exclusively to patients who have a prescription approved and registered with the Ministry of Health.

Deputy Ibarrola recalled that the Commission has already urged the Executive Branch, through a statement, to immediately provide medicine to people who need it and that it is contemplated in a current law but is not yet fulfilled.

The latter dictates that only pharmaceutical companies can be authorized to import this raw material. Still, this is a very important step and we are all very much in agreement with it.
