DIRECTIVOS DE UN CLUB CANNÁBICO ABSUELTOS POR EL TRIBUNAL CONSTITUCIONAL
El Tribunal Constitucional (TC) ha revocado la condena de seis meses de
cárcel y 83.681 euros de multa que la Audiencia de Santa Cruz de
Tenerife había impuesto a los directivos de un club de cannabis de Los
Cristianos, por considerar que se vulneró su derecho de defensa.
Los tres procesados,
Stephan Rudolf W., Arnaud R. y Fernando G.C., dirigían hasta 2013 en el
sur de Tenerife el Club Social de Consumidores de Cannabis TFS, que
llegó a tener 872 socios. El club disponía de sus propias fincas de cultivo -desmanteladas por la
Guardia Civil- que abastecían de cannabis a sus socios en un local del
centro comercial de Los Cristianos, bajo una serie de reglas, como que
nadie podía retirar más de tres gramos al día.
El Ministerio Fiscal denunció a sus responsables por undelitocontra
la salud pública, de promoción del consumo de drogas, pero el Juzgado
de lo Penal número 5 de Santa Cruz de Tenerife los absolvió. En síntesis, el juez entendió que los acusados habían infringido la ley
llevados por un "error invencible" o "inevitable", puesto que habían
registrado los estatutos del club, con el detalle de sus actividades,
tanto ante el Gobierno de Canarias como ante el Ayuntamiento de Arona
sin recibir ninguna objeción de ilegalidad.
La Audiencia Provincialrevocóla
absolución por considerar que no había tal error, sino que los
estatutos validados por las administraciones describían las actividades
del club con "una ambigüedad calculada" y que los procesados "no
desplegaron la diligencia necesaria para despejar las posibles dudas".
El Constitucional ampara ahora a los acusados yanula la condenapor
una vulneración de los derechos de defensa. Entienden sus magistrados
que la Audiencia de Santa Cruz de Tenerife cambió los hechos declarados
probados por el Juzgado de lo Penal en un aspecto que exigía escuchar de
nuevo a los acusados, cosa que no se hizo.
Para el Alto Tribunal, la Audiencia cometió ese error al modificar en
los hechos probados cuál fue el efecto que tuvo la aprobación de los
estatutos del club sobre el conocimiento que los procesados poseían
sobre la licitud o ilicitud de sus actividades. "Se trataba de una cuestión que afectaba a la declaración de
culpabilidad o inocencia y que, por tanto, no podía ser resuelta sin dar
la posibilidad a los recurrentes de ser oídos personalmente, sin que
dicha garantía pudiera ser sustituida por el trámite de alegaciones
concedido a su abogado", razona la sentencia. Elfallo absolutoriose basa en esa vulneración, no en el juicio que ese tipo de actividades merecen al Tribunal Constitucional.
De hecho, la sentencia precisa que a lo largo de los últimos años, el Tribunal Constitucional ha distinguido conceptualmente dos tipos de asociaciones cannábicas: los que sirven de abastecimiento, dispensación y consumo de cannabis, y las asociaciones orientadas con fines informativos, de estudio, de debate y similares. Y subraya que el derecho de asociación que consagra la Constitución no da cobertura a los primeros, que pueden incurrir en un delito contra la salud pública, ni "normaliza" su actividad.

The Constitutional Court (TC) has revoked
the sentence of six months in prison and 83,681 euros of fine that the
Audiencia of Santa Cruz de Tenerife had imposed on the directors of a
cannabis club in Los Cristianos, considering that their right to
defending.
The three defendants, Stephan Rudolf W.,
Arnaud R. and Fernando G.C., directed until 2013 in the south of
Tenerife the Social Club of Cannabis Consumers TFS, which reached 872
members. The club had its own cultivation farms - dismantled by the
Civil Guard - that supplied cannabis to its members in a Los Cristianos
shopping center, under a series of rules, such as that no one could
withdraw more than three grams a day.
The
Public Prosecutor´s Office denounced those responsible for a crime
against public health, to promote the use of drugs, but the Criminal
Court No. 5 of Santa Cruz de Tenerife acquitted them. In
summary, the judge understood that the defendants had violated the law
carried out by an "invincible error" or "inevitable", since they had
registered the club´s statutes, with details of their activities, both
before the Government of the Canary Islands and before the Arona City
Council without receiving any objection of illegality.
The
Provincial Court revoked the acquittal on the grounds that there was no
such error, but the statutes validated by the administrations described
the activities of the club with "a calculated ambiguity" and that the
defendants "did not deploy the necessary diligence to clear any doubts".
The Constitutional now protects the accused
and annuls the sentence for a violation of the rights of defense. His
magistrates understand that the Audiencia of Santa Cruz de Tenerife
changed the facts declared proven by the Criminal Court in an aspect
that required listening to the accused again, which was not done.
For the High Court, the Court made that
mistake by modifying in the proven facts what was the effect of the
approval of the club´s statutes on the knowledge that the defendants had
about the legality or illegality of their activities. "This was an
issue that affected the declaration of guilt or innocence and that,
therefore could not be resolved without giving the appellants the
possibility to be heard personally, without this guarantee being
replaced by the processing of allegations granted. to his lawyer" the
sentence reasons. The acquittal is based on that violation, not on the
judgment that such activities deserve the Constitutional Court.
